I live in Indiana. I was convicted of a second offense Felony DUI. Here are the circumstances. I had a minor accident that resulted in $35.00 worth of damage to each car. Just the side mirrors were broken. Both the other driver and myself received minor cuts and scratches. I gave the kid my address, name and phone number. At the time of the accident I was in the middle of a severe panic attach. The accident sure didn't help. I was on my way to the liquor store at the time of the accident. After giving my information to the kid I went right next door to the liquor store and then proceeded home. Also just within a couple blocks of the accident and the liquor store. I proceeded to drink as soon as I got home. Between the alcohol and the Adivan that I took, my panic attach started to subside. 1 1/2 hours after the accident and almost a pint of Jim Beam later a cop arrived at my door. He said that I was reported in a hit and run earlier that day. Needless to say, I told him that was false which lead to even more problems. I did agree to take the field test, but told him that I had been drinking for an hour and a half. I registered a .12. When he informed me that I was under arrest for leaving the scene of an accident and DWI and false informing I was stunned. I refused the Breathalyzer at the jail he informed me that I would be suspended for 2 years automatically. I told him that if I had to take a Breathalyzer after drinking in my own house. Take my license. The part the really gripes my butt is that even with the kid I had the accident with testifying that I had no alcohol on my breath and did not appear to have consumed any alcohol at all, I was still found guilty on all counts. Not to mention, the accident was June 27, 2008. My trial was August, 31 2009 and my sentencing was November 18, 2009. How is that quick and speedy. Now I have been going through this for almost 2 yrs and now have to go through it for another 2 or more. Any thoughts?
