<description><![CDATA[<p>I have a hypothetical situation if you have time for it:</p>

<p>It's after midnight.  An intoxicated driver has a single-car accident and his disabled car is partially in the road.  Ten minutes later, a motorcyclist who witnesses say was doing a 'wheelie' slams into the disabled car.</p>

<p>Can/should the car's driver be charged with intoxication manslaughter?</p>]]></description>
